Welcome to Monitorea. By accessing or using our service, you agree to be bound by these Terms of Service. Please read them carefully.
Monitorea is operated by DBG Labs LLC, a Puerto Rico limited liability company ("Company," "we," "us," or "our"). Our principal place of business is in San Juan, Puerto Rico.
By creating an account or using Monitorea, you agree to these Terms of Service and our Privacy Policy. If you do not agree, you may not use our service.
Monitorea provides AI-powered media monitoring services for radio, TV, and podcast content in Puerto Rico. Our service includes broadcast monitoring, transcription, search, alerts, and clip creation features.
You must provide accurate and complete information when creating an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
Paid subscriptions are billed in advance on a monthly or annual basis. All payments are non-refundable except as required by law. We reserve the right to change our prices with 30 days notice.
You agree not to use our service to: violate any laws; infringe on intellectual property rights; distribute malware; attempt to gain unauthorized access; or interfere with the proper functioning of our service.
The monitored broadcast content remains the property of its respective owners. Monitorea provides transcriptions and clips for informational and research purposes. You may not redistribute monitored content without appropriate authorization.
Your use of Monitorea is subject to our Privacy Policy, which describes how we collect, use, and protect your information.
Our service is provided "as is" without warranties of any kind. We do not guarantee that our service will be uninterrupted, error-free, or that all content will be accurately transcribed.
To the maximum extent permitted by law, Monitorea shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the service.
We may terminate or suspend your account at any time for violation of these terms. You may cancel your subscription at any time through your account settings.
Both parties agree to maintain the confidentiality of any proprietary or confidential information disclosed during the use of our service. This includes, but is not limited to, business strategies, customer lists, monitoring configurations, and any data derived from the service. This obligation survives termination of these Terms.
You agree to indemnify, defend, and hold harmless Monitorea and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of the service; (b) your violation of these Terms; (c) your violation of any third-party rights; or (d) any content you submit through the service.
Neither party shall be liable for any failure or delay in performing their obligations under these Terms due to circumstances beyond their reasonable control, including but not limited to natural disasters, acts of war or terrorism, labor disputes, government actions, power failures, internet or telecommunications failures, or pandemics.
We strive to maintain 99.9% uptime for our service. Scheduled maintenance will be announced at least 24 hours in advance when possible. Enterprise customers may negotiate specific service level agreements with dedicated support terms.
These Terms shall be governed by and construed in accordance with the laws of the Commonwealth of Puerto Rico, without regard to its conflict of law principles. Any legal action or proceeding arising under these Terms shall be brought exclusively in the federal or state courts located in San Juan, Puerto Rico, and the parties hereby consent to personal jurisdiction and venue therein.
Any dispute arising from these Terms or your use of the service shall first be attempted to be resolved through good-faith negotiations between the parties. If the dispute cannot be resolved within thirty (30) days, either party may initiate binding arbitration under the rules of the American Arbitration Association. The arbitration shall be conducted in San Juan, Puerto Rico, in English. The arbitrator's decision shall be final and binding. Notwithstanding the foregoing, either party may seek injunctive relief in court for violations of intellectual property rights or confidentiality obligations.
We reserve the right to modify these terms at any time. We will notify you of material changes by email or through our service. Continued use after changes constitutes acceptance.
